This Privacy Policy explains how AGENTYO SOLUTIONS PRIVATE LIMITED ("agentyo", "we", "us" or "our") collects, uses, shares and protects personal data when you visit www.agentyo.ai, contact us, or communicate with us, including through WhatsApp.

1. Who we are

agentyo is the brand name of AGENTYO SOLUTIONS PRIVATE LIMITED, a company incorporated in India. We are the data fiduciary responsible for the personal data described in this policy.

2. Data we collect

We collect only the personal data needed for the purposes described below:

• Contact enquiries: your name, company name, job title and the details of your enquiry when you contact us.
• Email: your email address and the content of emails you send to us.
• WhatsApp messages: your WhatsApp phone number, profile name, and the content of messages you exchange with us on WhatsApp, along with delivery and read status.
• Cookies and analytics: technical data such as IP address, browser type, device information, pages visited and time spent on the site, collected through cookies or similar technologies.

3. Purpose of processing

We process personal data to:

• respond to your enquiries and provide information about our services;
• communicate with you about proposals, projects and services you have requested;
• send service-related messages, and, where you have opted in, updates through email or WhatsApp;
• operate, secure and improve our website;
• comply with legal obligations and enforce our agreements.

We process personal data on the basis of your consent or for legitimate uses permitted under applicable law, including the Digital Personal Data Protection Act, 2023.

4. WhatsApp Business messaging

We use the WhatsApp Business Platform, provided by Meta Platforms, Inc. and its affiliates, to communicate with customers and prospective customers.

• Opt-in: we send WhatsApp messages only to people who have given us their WhatsApp number and agreed to be contacted on WhatsApp, for example by messaging us first or by opting in through a form or in writing.
• Message types: messages may include replies to your enquiries, service and project updates, and, only where you have opted in, information about our services.
• Opt-out: you can stop receiving WhatsApp messages from us at any time by replying STOP to any of our messages, or by emailing contact@agentyo.ai. We will process your request promptly and will not send further messages except a confirmation of your opt-out.

Messages sent through WhatsApp are also subject to WhatsApp's Privacy Policy.

5. Sharing with service providers

We do not sell your personal data. We share personal data only with service providers that help us run our business, and only to the extent needed for them to provide their services to us. These may include:

• Meta Platforms, Inc. / WhatsApp, as our messaging provider for WhatsApp Business communications;
• email and productivity service providers;
• website hosting, content delivery and security providers;
• analytics providers, where used.

We may also disclose personal data where required by law, court order or a government authority, or to protect our rights, users or the public. Some service providers may process data outside India. Where they do, we take reasonable steps to ensure the data is protected in line with this policy and applicable law.

6. Data retention

We keep personal data only for as long as needed for the purposes described in this policy, or as required by law. When personal data is no longer needed, or when you withdraw consent and no legal basis for keeping it remains, we delete or anonymise it.

7. Security

We use reasonable technical and organisational safeguards to protect personal data against unauthorised access, loss, misuse or alteration. These include encrypted (HTTPS) connections to our website and access controls on our systems. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

8. Your rights

Subject to applicable law, you have the right to:

• Correction: ask us to correct, complete or update inaccurate or incomplete personal data;

• Grievance redressal: raise a grievance with us, and, if it is not resolved, complain to the Data Protection Board of India;
• Nominate: nominate another person to exercise your rights in the event of your death or incapacity.

9. Digital Personal Data Protection Act, 2023

We process personal data in line with India's Digital Personal Data Protection Act, 2023 (DPDP Act) and the rules made under it. Under the DPDP Act, AGENTYO SOLUTIONS PRIVATE LIMITED acts as a data fiduciary for the personal data described in this policy.

10. Children's data

Our website and services are intended for businesses and are not directed at children. We do not knowingly collect personal data from anyone under 18 years of age. If you believe a child has given us personal data, please contact us and we will delete it.
